Accepting these terms
These terms apply when you use the mWill website and app. In these terms, “mWill”, “we” and “us” mean the operator of the mWill platform, and “you” means the person using it.
By creating an account or using mWill, you agree to these terms and to our privacy policy. If you do not agree, please do not use mWill.
Pre-production status
mWill is in pre-production. Licensed lawyers and notaries have not yet reviewed the will templates or signing instructions. A qualified scholar has not yet signed off on the Faraid calculations.
Do not use mWill to prepare a will you intend to rely on yet. Features may change, and documents prepared today may need to be redone once reviews are complete. We will update these terms and remove the pre-production label when the platform is ready.
What mWill does and does not do
mWill is a document preparation tool. It:
- guides you through questions about your family, assets and wishes;
- calculates Faraid shares based on your answers;
- prepares will documents as PDF and DOCX files; and
- gives you general signing instructions for your province or territory.
mWill does not:
- give legal advice or act as your lawyer or notary;
- give religious rulings or act as a religious authority; or
- check whether your will suits your personal situation.
Using mWill does not create a lawyer-client or notary-client relationship between you and mWill. Nothing on the platform is legal or religious advice.
Your responsibilities
- Give accurate information. Your documents are only as accurate as your answers. Review everything before you sign.
- Sign properly. A will is only valid if it is signed the way your province requires, usually in front of witnesses. Follow the signing instructions carefully and keep the signed original somewhere safe.
- Get professional review. We strongly recommend that a lawyer or notary in your province reviews your will before you sign it, and that a qualified scholar reviews your Faraid result.
- Keep your will up to date. Review it after major life events such as marriage, divorce, a birth or a death in the family.
Faraid calculations
The Faraid engine follows majority Sunni positions and calculates shares in exact fractions. Until a qualified scholar has reviewed and signed off on the engine, its results are for information only. They are not a fatwa. Your family circumstances, or the school of thought you follow, may lead to a different result.
Accounts and security
You must be at least 18 years old to create an account. Each account is for one person.
Keep your password private and turn on multi-factor authentication. You are responsible for activity on your account. If you think someone else has accessed it, change your password and email support@muslim-will.ca right away.
Organizations and professionals
Mosques, community organizations, lawyers and notaries that appear on mWill are independent of us. They are not our employees or agents.
An organization sees only that you have a will, unless you give consent for a specific version. If you contact a lawyer or notary through the directory, any consultation, advice or fee is a matter between you and that professional. We are not responsible for their advice or services.
Acceptable use
When you use mWill, you agree not to:
- prepare a will for someone else without their knowledge and permission;
- enter information you know is false or that you have no right to share;
- try to access accounts, wills or data that are not yours;
- interfere with, overload or probe the security of the platform; or
- copy, resell or automate access to the platform without our written permission.
If you find a security issue, please report it to support@muslim-will.ca rather than testing it further.
Intellectual property
The mWill platform, including its software, design, text and templates, belongs to us or our licensors. The information you enter is yours. You may use, print and share the documents mWill prepares for you for your own estate planning.
Limitation of liability
mWill is provided “as is” during pre-production. We work hard to make it accurate and reliable, but we cannot promise that it will be free of errors or always available, or that a document will meet the legal requirements for your situation.
To the extent the law allows, we are not liable for losses that come from relying on mWill documents or calculations without professional review, or from a will that was not signed correctly. Some laws, including consumer protection laws in Quebec, do not allow certain limits. Where that is the case, these limits do not apply to you.
This section is a plain-language draft. Counsel will finalize it before launch.
Ending your use
You can stop using mWill at any time. To close your account, email support@muslim-will.ca. Self-service account deletion is being built.
We may suspend or close an account that breaks these terms or puts other users or the platform at risk. Where we can, we will tell you first and give you a chance to download your documents.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. This clause is a draft pending review by counsel, and it does not remove any rights you have under the consumer protection laws of your own province.
Changes to these terms
We will update these terms as mWill moves toward launch, and we will change the date at the top of this page. If a change is significant, we will tell you by email or in the app before it takes effect. If you keep using mWill after that, the new terms apply.
